These Terms of Use (this “Agreement”) govern your access to and use of the Tigervue AR Virtual Clothes & Bags Try-On Demonstration (the “Website”), operated by Tigervue AR Pvt. Ltd. and its affiliates (together, “Tigervue,” “we,” “us,” or “Company”). By accessing or using the Website on your mobile browser, you agree to be bound by these Terms. If you do not agree, do not access or use the Website.
1. Acceptance & Modifications
1.1. Acceptance. By visiting or using the Website, you confirm that you have read, understood, and accept these Terms in full.
1.2. Updates. We may revise these Terms to reflect changes in law (including India’s Digital Personal Data Protection Act, 2023 and the IT Act, 2000), our operations, or industry practices. We will post a notice of material changes and update the “Last updated” date. Continued use after posting constitutes your acceptance of the new Terms.
2. Eligibility & License
2.1. Eligibility. You must be at least 18 years old and not barred under any Indian or other applicable law from using the Website.
2.2. License. Subject to these Terms, we grant you a limited, personal, non-exclusive, revocable, non-transferable license to access and use the Website (including our virtual Masks) solely for your personal, non-commercial, lawful try-on of clothes and bags.
3. Permitted & Prohibited Uses
3.1. Permitted Uses. You may use the Website to virtually try on clothes and bags in real time.
3.2. Prohibited Uses. You agree not to:
- Violate any law or third-party rights (IP, privacy, publicity).
- Impersonate any person or send unsolicited messages (spam).
- Reverse-engineer or tamper with the Website or its code.
- Use the Website for commercial resale, sublicensing, or third-party services.
- Upload illegal, hateful, obscene, or infringing Content.
Circumvent technical protections or export controls.
4. Your Content & Rights Granted
4.1. Your Content. You may upload photos/videos of your body (shape, feet, arms, torso) to apply our virtual Masks (“Your Content”).
4.2. Your Warranties. You warrant you own or have rights to Your Content, and it does not infringe any third-party rights.
4.3. License to Tigervue. By uploading Your Content, you grant Tigervue a worldwide, royalty-free, perpetual, sublicensable, transferable license to use, reproduce, modify, and display Your Content solely to operate, improve, and market the Website and our AR technologies (including training our neural networks), without transferring your identity to any third party.
5. Privacy & Age Restrictions
5.1. Privacy. Our collection and use of personal data is governed by our Privacy Policy, which you must read alongside these Terms.
5.2. Children. The Website is not intended for anyone under 18. We do not knowingly collect data from minors. If you believe we have, contact support@tigervue.ar to request deletion.
6. Compliance with Indian Laws
6.1. You agree to comply with:
- India’s Information Technology Act, 2000 (and its Rules).
- Digital Personal Data Protection Act, 2023 (and Indian personal data rules).
- Any applicable Indian economic sanctions or export control laws.
6.2. Export Controls. You will not export or re-export any part of the Website or its technical data in violation of Indian export control laws.
7. Security & Integrity
7.1. You shall not disrupt or degrade the Website’s operation, introduce malware, or attempt unauthorized access.
7.2. Any breach of security or unauthorized use must be reported immediately to security@tigervue.ar.
8. Third-Party Services
The Website may integrate third-party analytics or allow content sharing via external services (e.g., Google, Amplitude). Those services’ own terms and privacy policies apply to their handling of your data; we are not responsible for their practices.
9. Warranty Disclaimer
THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED OR EXPRESS WARRANTIES, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Tigervue DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. USE IS AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Tigervue AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OR INABILITY TO USE THE WEBSITE. Tigervue’s TOTAL LIABILITY SHALL NOT EXCEED ₹1,000 OR THE AMOUNT YOU PAID (IF ANY) FOR ACCESS, WHICHEVER IS LOWER.
11. Indemnification
You agree to defend and indemnify Tigervue, its officers and agents, from any third-party claims, damages, or expenses (including legal fees) arising out of your breach of these Terms or your upload of infringing Content.
12. Term & Termination
12.1. Termination by Tigervue. We may suspend or terminate your access with immediate effect for any breach of these Terms.
12.2. Effects of Termination. Your license ends; you must stop using and delete all copies of any Website components stored on your device. Surviving provisions: Sections 4 (Your Content), 6 (Compliance), 9 (Disclaimer), 10 (Liability), 11 (Indemnity), 15 (Dispute Resolution), and this Section 12.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of India. Exclusive jurisdiction lies with the courts of New Delhi. Any dispute must be filed within one year of the cause of action.
14. Miscellaneous
14.1. Assignment. You may not assign your rights or obligations without our prior written consent; Tigervue may assign freely.
14.2. Severability. If any provision is held invalid, the remainder shall continue in full force.
14.3. Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement regarding the Website
