TERMS OF USE

These Terms of Use (this “Agreement” or “Terms of Use”) constitute a legally binding agreement between you (“you” or “User”) and Tigervue AR Private Limited and its affiliates (collectively, “Company,” “Tigervue AR,” “we” or “us”) governing your download, installation, access, and use of any of Tigervue AR’s mobile applications available on iOS or Android (the “App”), the servers used by the App, the computer files stored on such servers, and all related services, including the AR “Masks” for watches, bracelets, shoes, bags, clothes, eyewear or other branded items, features and content offered by the Company (collectively, the “App”).
1. ACCEPTANCE OF THE AGREEMENT
Please read this Agreement carefully. By downloading, installing, accessing or using the App, or by clicking “I accept” (or equivalent), you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these Terms of Use, you must not download, install, access or use the App.
We may modify this Agreement at any time. We will notify you of material changes by posting the updated Agreement in the App or via email. Your continued use of the App after notification constitutes acceptance of the updated terms.
2. LIMITED LICENSE TO THE APP
Subject to your compliance with this Agreement, we grant you a personal, worldwide, revocable, non-transferable and non-exclusive license to download, install, access and use the App (including Masks, as defined below) for your personal, non-commercial use.
All rights, title and interest in and to the App, not expressly granted herein, are reserved by the Company. Any use of the App beyond the scope of this license requires our prior written permission (contact: legal@tigervue.com).
3. USE OF THE APP
- No registration is required to access and use the App.
- “Masks” means the AR filters provided by us to virtually “try on” branded items (watches, bracelets, shoes, bags, clothes, eyewear, etc.) in real time using your device’s camera.
- You may use the App only for lawful purposes and in accordance with this Agreement. You must not:
- Infringe any intellectual property, privacy, publicity or other rights;
- Impersonate any person or entity;
- Send spam, unsolicited messages or other impermissible communications;
- Upload or transmit illegal, obscene, hateful or harassing content;
- Reverse-engineer, decompile or otherwise attempt to derive source code from the App.
4. YOUR CONTENT
As part of your use, you may upload photographs or images of yourself (“Content”). You alone are responsible for your Content. You warrant and represent that you own all rights to your Content or have obtained all necessary permissions. By uploading Content, you grant Tigervue AR a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, modify, reproduce, distribute, display and perform your Content in connection with the App and our marketing, improvement and promotional activities.
5. PRIVACY POLICY & AGE LIMITATIONS
We care about your privacy. Our Privacy Policy explains how we collect, use and share your personal information.
The App is not intended for use by children under 18 years old. If you are under 18, you must not use the App. If we learn that a user under 18 has provided personal data without parental consent, we will delete such data upon request.
6. EXPORT & ECONOMIC SANCTIONS CONTROL
You agree to comply with India’s Foreign Trade (Development & Regulation) Act, 1992, and all applicable export control laws. You represent that you are not located in any country or territory subject to a trade embargo or sanctions under Indian law or United Nations Security Council resolutions.
7. SECURITY
You must not interfere with or disrupt the operation of the App or its servers. Reverse engineering or tampering with the App is expressly prohibited.
8. THIRD-PARTY SERVICES
The App may link to or integrate with third-party services. Your use of such services is subject to the third party’s terms and privacy policies. We do not endorse and are not responsible for third-party content, transactions, or services.
9. WARRANTY DISCLAIMER
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW, TIGERVUE AR DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIGERVUE AR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP. TIGERVUE AR’S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED ₹7,500 (INR SEVEN THOUSAND FIVE HUNDRED) OR THE AMOUNT YOU PAID FOR THE APP, WHICHEVER IS LOWER.
11.USE OF MOBILE DEVICES
You are responsible for providing and maintaining the device, data plan and internet connection required to use the App. Any fees charged by your mobile carrier are your sole responsibility.
12. ENFORCEMENT RIGHTS
We may monitor use of the App and remove or disable any Content or functionality that violates this Agreement or applicable law. We may cooperate with legal authorities in the investigation of any suspected wrongdoing.
13. CHANGES TO THE APP
We may modify, suspend or discontinue the App (or any features) at any time without notice or liability to you.
14. INDEMNITY
You agree to defend, indemnify and hold harmless Tigervue AR and its officers, directors, employees and agents from any claims, liabilities, damages, losses or expenses (including legal fees) arising from your breach of this Agreement or your misuse of the App.
15. TERMINATION & SURVIVAL
We may suspend or terminate your license to use the App at any time for any reason, including your breach of this Agreement. Sections 4 (Your Content), 9 (Warranty Disclaimer), 10 (Limitation of Liability), 12 (Enforcement Rights), 14 (Indemnity), 16 (Assignability), 17 (Dispute Resolution), 18 (Miscellaneous), and 19 (Contact Us) will survive termination.
16. ASSIGNABILITY
You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign this Agreement in connection with a merger or sale of assets, or to an affiliate.
17. REFERRAL FEES
We may receive referral fees from third-party merchants if you purchase items via links in the App. Such fees support App maintenance and improvement.
18. DISPUTE RESOLUTION
This Agreement is governed by the laws of India. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
19. MISCELLANEOUS
- Entire Agreement. This Agreement constitutes the entire agreement between you and Tigervue AR regarding the App.
- Severability. If any provision is held invalid, the remainder of the Agreement will remain in effect.
- No Waiver. Our failure to enforce any right is not a waiver of that right.
- Amendments. We may update this Agreement by posting revised terms in the App or at https://tigervue.com/terms.
